Conditions of Entry — DEALS DIRECT $18,000 CHRISTMAS GIVEAWAY! (the “Promotion”)

1. Information on how to enter forms part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these conditions of Entry.
2. Entry is open to all residents of Australia aged 18 years or older. Directors and employees (and their immediate families) of the Promoter, participating outlets and any of their agencies associated with this promotion are ineligible to enter. 
3. The competition commences on 26/10/09 at 00:01.01 (AEDST) and concludes on 13/11/09 at 23:59.59 (AEDST) (“Promotion Period”). Entries will be deemed to be accepted at the time of receipt by the Promoter.
4. To enter, subscribers of the Deals Direct website will be sent an email directing them to the Deals Direct website www.dealsdirect.com.au and will be required to enter their details (name and email address) as well as opt into the Deals Direct and Webjet newsletters within the promotional period. Upon successfully completing the entry form, each entrant will receive 1 entry into the major prize draws for the duration of the promotional period. 
5. Entrants will also have the opportunity to recommend friends to enter the promotion, during the promotional period. For every friend they recommend to join the promotion they will receive an additional 5 entries into the major prize draws.  If the persons they recommend to join the promotion are already a Deals Direct subscriber or do not enter the promotion successfully, this entry into the major prize draw will be deemed invalid.
6. Entries received during the Promotion Period will be entered into the Major Prize Draw. Entrants are only eligible to win one major prize for the duration of the promotion. (SA Exempt)
7. Incomplete, incomprehensible and illegible entries will be deemed invalid.
8. Individuals may enter as many times as they like (according to the conditions outlined in clause 4).
9. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and proof of entry validity (including online order number as a purchase requirement) in order to claim any prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 
10. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
11. The Promoter accepts no responsibility for any late, lost or misdirected entries or delays in the delivery of the online purchase due to technical disruptions, network congestion or for any other reason.
12. The Major Prize Draws will take place at 11:00 am (AEDST) at Oxygen Interactive, 2-6 Glenferrie Road, Malvern VIC 3144, on the date and time listed below.

14. Prizes or any component of a prize cannot be transferred and non-cash prizes cannot be redeemed for cash. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.  
15. The total prize pool is valued at up to $18,217.70 (Recommended Retail Price including GST). Prizes must be taken as offered and cannot be varied. Prizes are not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.
    
16. All other costs including accommodation, additional meals, additional flights, laundry services, transport to and from departure point, taxes (including applicable airport, arrival and departure taxes), insurance (and any applicable insurance excesses), travel insurance, passports and visas and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winners and their travel companions. This prize cannot be used in conjunction with any other discounts or special offers. Use of any passes and vouchers issued as part of the Prize are subject to prevailing terms and conditions of use and passes are only valid for use within the stated duration on the passes or vouchers issued or the duration of the winners’ holiday, whichever is earlier. Any tickets or passes which remain unused after the completion of the Prize holiday shall be deemed null and void.
    
17. Each winner is responsible for their entry, and the entry of their travel companion, into New Zealand and/or The United States Of America including the obtaining at the winner’s expense, and holding, of any necessary passports and visas. Each winner and their travel companion are responsible for obtaining (and the cost of obtaining) medical advice prior to taking the prize and obtaining any recommended vaccinations and immunisations in the manner required before travelling. Taking the travel prize is subject to any prevailing terms and conditions of accommodation/transport/services/ transfers/ or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, or their travel companion, are unable to use any element of the prize as stated for whatever reason, including refusal of entry or departure into or out of New Zealand or The United States of America or participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
    
18. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought. 19. The entire Prize must be taken by 30 June 2010. No extension of these travel dates will be permitted. The winners of the Prize and their travel companions will not accrue any frequent flyer points from taking the prize. All components of the Prize must be taken together. Accommodation at all hotels and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. Travel and accommodation is to be arranged by the Promoter and/or a licensed travel agent nominated by the Promoter.
20. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. By accepting a prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
21. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
22. Dollar values are in Australian dollars. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
23. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
24. Programming and other quality control errors will not invalidate an otherwise valid prize claim.
25. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
26. The Major Prize Draw winners will be notified by telephone within 2 days of the draw and will also be sent a letter advising them of their prize. The Major Prize Draw Winners names will be published in the Public Notices section of The Australian newspaper on 25th November 2009.
27. Prizes will only be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder). The winner will therefore be, in each case, the account holder.
28. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
29. The Promoter may conduct such further draws as are necessary at the same time and place as the original prize draws on 11th March 2010 in order to distribute any prizes unclaimed by that date, subject to any written directions given under relevant State or Territory legislation. In the event of any winners, they will have their details published in the Public Notices section of the Australian on 18th March 2010.
30. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Promotion result.
31. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
32. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
33. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
34. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability, which cannot be excluded by law. 
35. The Promoter, Oxygen Interactive Pty Ltd and their associated agencies and companies are not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries, and reserves the right to take any action that may be available.
36. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
37. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
38. All entries become the property of the Promoter. The information provided by entrants will be used by the Promoter for the purpose of conducting the Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting the Promotion or communicating with entrants and to State and Territory gaming authorities where required to do so. A request to access, update or correct any information should be directed to the Promoter.
39. Oxygen Interactive Pty Ltd, on behalf of the Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Oxygen Interactive Pty Ltd for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
